\nGenocide is intentional action to destroy a people (usually defined as an ethnic, national, racial, or religious group) in whole or in part.

\nAny of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:<\/p>\n(a) Killing members of the group;<\/p>\n
(b) Causing serious bodily or mental harm to members of the group;<\/p>\n
(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;<\/p>\n
(d) Imposing measures intended to prevent births within the group;<\/p>\n
(e) Forcibly transferring children of the group to another group.<\/p><\/blockquote>\n

\u201cWe reject this misguided motion which is based on a limited understanding of India, its constitution, society, ethos, rule of law and the judicial process,\u201d said external affairs ministry spokesperson Gopal Baglay.<\/p>\n
He said the views of the government \u201chave been conveyed to the government and political leadership in Canada\u201d.<\/p>\n
The private members\u2019 motion was moved by Harinder Malhi, the MPP from the riding (as constituencies are called in Canada) of Brampton-Springdale, near Toronto.<\/p>\n
After a debate, the motion was carried with 34 MPPs (the equivalent of MLAs) voting in favour and just five against. Those present at a vote numbered just about a third of the assembly\u2019s total strength of 107.
\nIndia\u2019s Consul General in Toronto Dinesh Bhatia, under whose jurisdiction this falls, had spent a frantic couple of days trying to prevent this occurrence.<\/p>\nA senior Indian official said this matter could have a negative impact on bilateral ties. Frustrated over the lack of action by prime minister Justin Trudeau\u2019s lieutenants, an official said, \u201cIf they can\u2019t manage their own party\u2026they have to own the responsibility.\u201d That was for allowing the MPP to proceed with the motion, thereby creating a platform for attacks on India over its \u201cintolerance\u201d.<\/p>\n
In introducing the motion, Malhi said the Legislative Assembly of Ontario should \u201ccondemn all forms of communal violence, hatred, hostility, prejudice, racism and intolerance in India and anywhere else in the world, including the 1984 Genocide perpetrated against the Sikhs throughout India, and call on all sides to embrace truth, justice and reconciliation.\u201d
